1. INTRODUCTION
This Property Listing Policy ("Policy") is issued by Kolahal Homes Private Limited, owner and operator of the Rented Ghar platform, to regulate the listing, publication, management, verification, promotion, booking, suspension, and removal of properties offered through the Rented Ghar website, mobile application, and allied digital platforms. This Policy applies to all property owners, co-owners, authorised representatives, lessors, licensors, developers, property managers, institutions, hostels, PG operators, serviced apartment operators, and any person seeking to list accommodation or related premises on the Rented Ghar platform.
2. DEFINITIONS
- Platform means the website, mobile application, digital interface, and booking system operated by Rented Ghar.
- Property includes apartment, flat, house, villa, hostel, PG accommodation, serviced apartment, room, dormitory, guest house, medical stay accommodation, event stay accommodation, or any other premises approved by Rented Ghar for listing.
- Owner means the person having legal ownership, lawful possession, leasehold rights, management rights, or written authority to offer the property for booking through the platform.
- Listing means publication or display of property information on the platform for booking or enquiry purposes.
3. ELIGIBILITY FOR LISTING
Only persons having lawful ownership, possession, leasehold rights permitting sub-licensing, management authority, or written authorisation from the lawful owner may list a property. The owner may be required to provide proof of ownership or authority, government-issued identity proof, address proof, PAN details, GST registration details where applicable, bank account details for payouts, property tax receipt where available, electricity bill or utility proof, occupancy or completion documents where applicable, fire safety compliance documents where applicable, and police or municipal licences where applicable.
Rented Ghar may verify ownership and authority through documentary review, telephonic verification, site inspection, public records, or third-party verification agencies. Rented Ghar may reject any property that fails verification, lacks lawful authority, is under legal dispute, is subject to governmental restriction, poses safety concerns, or otherwise does not meet platform standards.
4. PROPERTY INFORMATION
The owner shall provide true, complete, accurate, and up-to-date information regarding the property. The owner shall disclose exact location, property type, occupancy capacity, number of rooms and beds, available amenities, parking availability, utility availability, restrictions applicable to guests, pet policy, smoking policy, alcohol restrictions, accessibility limitations, and ongoing construction or maintenance affecting the stay.
Photographs uploaded must accurately represent the current condition of the property and shall not be materially misleading. The owner shall promptly update any change affecting availability, amenities, pricing, legal status, occupancy, or condition of the property. Material misrepresentation may result in suspension, cancellation of bookings, refund liability, financial penalties, removal from the platform, and legal action.
5. LISTING STANDARDS
The property shall be clean, hygienic, structurally safe, reasonably ventilated, and fit for temporary residential occupation. The property shall ordinarily provide functional access to water, sanitation, electricity, sleeping arrangements, and basic safety facilities. Where applicable, fire extinguishers, smoke alarms, emergency exits, electrical safety measures, and other safety equipment shall be maintained in working condition.
Properties used for unlawful activities, unsafe structures, unauthorised constructions, properties under sealing orders, hazardous premises, and properties prohibited by law shall not be listed. Rented Ghar may conduct physical or virtual inspections before or after listing and may require corrective action.
6. LISTING APPROVAL AND PUBLICATION
Approval of a listing is at the sole discretion of Rented Ghar. Upon approval, the listing may be published on the platform with property details, photographs, pricing, and availability. Rented Ghar may edit formatting, categorisation, descriptions, titles, or photographs for consistency, clarity, compliance, or marketing purposes without altering material facts. Publication of a listing does not guarantee enquiries, occupancy, revenue, or minimum bookings.
7. PRICING AND AVAILABILITY
The owner shall provide accurate pricing and availability information. Rented Ghar may facilitate dynamic pricing tools, promotional pricing, seasonal pricing, and discount campaigns, subject to the applicable commercial arrangement. The owner shall be responsible for applicable taxes unless otherwise agreed in writing. The owner shall maintain updated calendars and promptly block unavailable dates. The owner shall not knowingly accept overlapping reservations for the same accommodation.
8. BOOKING ACCEPTANCE
A booking becomes binding upon confirmation through the platform. The owner shall honour confirmed bookings except in circumstances permitted by applicable agreements or law. The owner may refuse accommodation only on lawful and non-discriminatory grounds and shall promptly notify Rented Ghar. Owner-initiated cancellation after confirmation may attract penalties, refund liability, compensation obligations, ranking impact, suspension, or removal from the platform.
9. GUEST MANAGEMENT
The owner shall follow check-in procedures prescribed by Rented Ghar, including identity verification and police verification compliance. Accurate guest records shall be maintained where required by law. The owner shall reasonably enforce house rules and report serious violations to Rented Ghar. The owner shall not unlawfully discriminate against guests on grounds prohibited by applicable law.
10. COMMISSIONS, PAYOUTS, AND CHARGES
Commissions, service fees, payout schedules, deductions, taxes, and settlement procedures shall be governed by the applicable commercial agreement between the owner and Rented Ghar. Rented Ghar may deduct commission, taxes, refunds, chargebacks, penalties, or other recoverable amounts before releasing payouts. The owner shall provide accurate bank account details and shall be responsible for errors in payout information.
11. MAINTENANCE AND SERVICE LEVELS
The owner shall maintain the property in substantially the same condition as represented in the listing. Urgent repairs affecting safety, sanitation, electricity, water supply, or occupancy shall be attended to promptly. Repeated complaints regarding cleanliness, maintenance, safety, amenities, or service quality may result in corrective action requirements, temporary suspension, or delisting.
12. PROHIBITED LISTING PRACTICES
The following practices are prohibited: fake listings; duplicate listings without approval; bait pricing; misleading photographs; hidden mandatory charges; unlawful occupancy arrangements; unauthorised subletting; acceptance of off-platform payments contrary to platform policy; manipulation of reviews; harassment of guests; unlawful surveillance within guest areas.
13. REVIEWS AND RATINGS
Guests may submit reviews and ratings after completion of the stay. Rented Ghar may moderate, remove, or refuse reviews that are unlawful, abusive, defamatory, fraudulent, irrelevant, or in violation of platform policies. Owners shall not coerce, incentivise improperly, fabricate, purchase, or manipulate reviews.
14. DATA PROTECTION AND CONFIDENTIALITY
Guest personal data received by the owner shall be used only for booking fulfilment, check-in, security, police verification, and lawful operational purposes. The owner shall maintain confidentiality of guest information and shall not disclose, sell, rent, or misuse such information. The owner shall comply with the Digital Personal Data Protection Act, 2023 and applicable privacy obligations.
15. INSURANCE
The owner is encouraged to maintain adequate property insurance, liability insurance, fire insurance, and other relevant coverage. Rented Ghar does not provide insurance coverage for the property, owner liabilities, guest belongings, or business interruption unless expressly stated in writing.
16. SUSPENSION AND DELISTING
Rented Ghar may suspend or remove a listing for: legal non-compliance; safety concerns; fraud; repeated guest complaints; owner cancellation abuse; non-payment of dues; data misuse; prohibited activities; governmental directions; breach of this Policy. In urgent situations affecting safety, legality, or public interest, suspension or delisting may be immediate and without prior notice. Delisting shall not affect accrued rights, liabilities, refund obligations, indemnities, or pending disputes.
17. INDEMNITY
The owner shall indemnify and keep indemnified Kolahal Homes Private Limited, its directors, officers, employees, agents, affiliates, and representatives against all claims, losses, damages, penalties, liabilities, proceedings, costs, and expenses arising from: breach of this Policy; false ownership claims; inaccurate listing information; guest injury caused by property defects; legal non-compliance; tax liabilities attributable to the owner; infringement of third-party rights; acts or omissions of the owner or property staff.
18. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Rented Ghar shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages, loss of profit, loss of revenue, loss of goodwill, loss of occupancy, business interruption, or losses arising from guest conduct, property defects, third-party services, utility failures, governmental actions, or force majeure events. The aggregate liability of Rented Ghar in relation to a specific listing shall not exceed the commission actually earned by Rented Ghar from the booking giving rise to the claim.
19. AUDIT AND RECORDS
Rented Ghar may request records relating to bookings, guest registration, police verification, taxes, invoices, and payouts for audit, compliance, dispute resolution, or legal purposes. The owner shall cooperate with such requests to the extent required by law and contractual obligations.
20. GOVERNING LAW AND DISPUTE RESOLUTION
This Policy shall be governed by the laws of India. Any dispute arising out of or relating to this Policy shall first be attempted to be resolved amicably. Failing amicable resolution, the dispute may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Lucknow, Uttar Pradesh, India, and the proceedings shall be conducted in English. Subject to the arbitration clause, the courts at Lucknow, Uttar Pradesh shall have exclusive jurisdiction.
21. AMENDMENTS
Rented Ghar reserves the right to amend, modify, replace, or update this Policy at any time for legal, regulatory, operational, commercial, or security reasons. Updated versions shall become effective from the date specified therein, and continued use of the platform shall constitute acceptance of the revised Policy.
23. MANDATORY DOCUMENTS
Every property owner seeking to list a property on the Rented Ghar platform shall submit all documents reasonably required by Rented Ghar for verification, legal compliance, security assessment, taxation purposes, and operational due diligence before publication of the listing.
Depending upon the nature of the property, the owner may be required to submit one or more of the following documents: proof of ownership such as sale deed, conveyance deed, allotment letter, registered lease deed, or other title document; written authority from the owner where the listing is submitted by a manager, relative, agent, or representative; government-issued identity proof of the owner or authorised representative; address proof; PAN card; GST registration certificate where applicable; bank account proof for payout processing; recent electricity bill, water bill, or utility bill; property tax receipt where available; occupancy certificate, completion certificate, or possession letter where applicable; fire safety compliance documents where applicable; municipal licence, lodging licence, hostel registration, PG registration, or tourism approval where required by law.
24. PHOTOS
All photographs uploaded to the platform shall accurately represent the current condition, layout, amenities, furnishings, cleanliness, and occupancy status of the property. Photographs shall be clear, recent, adequately lit, and free from misleading editing, artificial enhancement, stock imagery, or deceptive visual representation.
The owner grants Rented Ghar a non-exclusive, royalty-free licence to host, display, resize, crop, optimise, and use the photographs for listing publication, search display, advertising, promotional campaigns, social media promotion, and other lawful business purposes connected with the platform.
25. PRICING
The owner shall provide accurate base pricing, occupancy pricing, additional guest charges, utility charges where applicable, security deposit requirements, cleaning charges, and all mandatory charges associated with the stay. All mandatory charges must be disclosed before booking confirmation. Hidden charges, compulsory cash payments at check-in, undisclosed service fees, or misleading pricing practices are prohibited.
26. FALSE INFORMATION
The owner shall not provide false, misleading, exaggerated, incomplete, deceptive, or inaccurate information in any listing, communication, document, advertisement, or booking interaction. Material information includes ownership status, legal status, occupancy capacity, location, amenities, safety features, parking availability, internet availability, air-conditioning, lift availability, water supply, power backup, accessibility features, and restrictions applicable to guests.
27. DUPLICATE LISTINGS
The same room, bed, apartment, house, or accommodation unit shall not be listed multiple times on the Rented Ghar platform without prior written approval. This restriction is intended to prevent overbooking, guest confusion, manipulation of search rankings, artificial inventory inflation, and unfair marketplace practices.
28. ILLEGAL PROPERTY
Properties that are unlawful, unauthorised, prohibited, or otherwise ineligible for lawful occupancy shall not be listed on the platform. The following may be treated as illegal properties: unauthorised constructions; properties under demolition orders; properties under sealing orders; encroached properties; properties lacking legally required occupancy permissions where mandatory; properties prohibited from residential or lodging use by competent authorities; properties used for unlawful activities.
29. COMMERCIAL PROPERTY
Commercial premises may be listed only if: applicable law permits temporary accommodation or the intended use; necessary licences and permissions are obtained; safety requirements are satisfied; zoning and land-use regulations are complied with. Rented Ghar may require trade licences, commercial occupancy approvals, fire safety certificates, tourism approvals, GST registration, or other commercial compliance documents.
30. RESIDENTIAL PROPERTY
Residential properties listed on the platform shall comply with applicable residential zoning rules, building regulations, society rules, municipal regulations, and occupancy restrictions. Where a resident welfare association, apartment association, housing society, or similar body imposes restrictions on short-term stays, the owner shall ensure compliance with such restrictions and obtain necessary permissions where required.
31. FRAUD PREVENTION
Rented Ghar may implement identity verification, document verification, payment verification, device monitoring, behavioural analytics, geolocation checks, fraud screening tools, and other reasonable measures to prevent fraudulent activity. The owner shall cooperate with fraud investigations and provide additional information reasonably requested by Rented Ghar.
32. LISTING REMOVAL
The owner may request removal of a listing through the designated platform process, subject to completion of pending bookings and settlement obligations. Rented Ghar may remove a listing for reasons including: breach of this Policy; false information; duplicate listing; illegal property concerns; repeated guest complaints; safety concerns; fraud suspicion; non-compliance with documentation requirements; governmental or judicial directions; non-payment of dues; inactivity for an extended period.
