PART A: GENERAL PAYMENT TERMS

1. INTRODUCTION

These Payment Terms ("Terms") govern all payments made to or through Kolahal Homes Private Limited, operating under the brand name Rented Ghar, in relation to accommodation bookings, property management services, rental services, interior services, painting services, ancillary services, deposits, and any other services offered through the Rented Ghar platform.

2. DEFINITIONS

  • Booking Amount: The amount payable for accommodation or services before taxes, fees, and additional charges.
  • Security Deposit: A refundable amount collected to secure performance of guest obligations and cover damages or outstanding dues.
  • Payout: Amount payable by Rented Ghar to a property owner after deductions permitted under applicable agreements.
  • Payment Gateway: A regulated third-party payment service provider facilitating online payment transactions.

3. PAYMENT METHODS

Payments may be made through UPI, debit card, credit card, net banking, wallet, bank transfer, payment gateway link, QR code, or other methods approved by Rented Ghar. Users shall make payments only through authorised payment channels communicated by Rented Ghar. Cash payments are discouraged unless expressly permitted in writing.

4. BOOKING PAYMENTS

Rented Ghar may require full or partial advance payment before confirmation of a booking. A booking is confirmed only after successful receipt of payment and issuance of a booking confirmation.

5. SECURITY DEPOSIT

Rented Ghar may collect a security deposit before check-in, at check-in, or during the stay. The security deposit may be used to recover unpaid charges, damage charges, cleaning charges, utility charges, late checkout charges, key replacement charges, or other liabilities arising during the stay. Subject to inspection and settlement of dues, the refundable balance shall be processed through an approved payment channel within a reasonable period.

6. TAXES

Applicable GST shall be charged in accordance with the Central Goods and Services Tax Act, 2017 and applicable Uttar Pradesh GST laws. Tax invoices may be issued electronically and shall be treated as valid invoices under applicable law.

7. PAYMENT GATEWAY TERMS

Online payments are processed through independent payment gateways and banking networks. Users may be subject to the terms and privacy policies of the relevant payment service provider. Rented Ghar shall not be liable for delays, failures, reversals, technical errors, banking downtime, network failure, or other issues attributable to payment service providers.

8. FAILED, PENDING, OR REVERSED PAYMENTS

If a payment fails but the amount is debited from the user's account, refund shall be subject to confirmation from the payment gateway or bank. Bookings associated with pending payment status may remain unconfirmed until successful settlement. Rented Ghar may reverse or cancel transactions that are duplicated, erroneous, fraudulent, unauthorised, or otherwise invalid.

9. REFUNDS

Refunds shall be governed by the applicable Cancellation & Refund Policy and booking terms. Approved refunds shall ordinarily be processed through the original payment method, unless technically impossible or otherwise agreed. Gateway charges, taxes already remitted, administrative charges, and other lawful deductions may be deducted where permitted by law.

10. CHARGEBACKS AND PAYMENT DISPUTES

Users shall first contact Rented Ghar customer support before initiating a chargeback or payment dispute. Rented Ghar may investigate disputed transactions and may provide booking records, communications, identity verification records, and payment records to banks, gateways, or authorities. Fraudulent or unjustified chargebacks may result in recovery proceedings, account suspension, denial of future services, and legal action.

11. PROPERTY OWNER PAYOUTS

Payouts to property owners shall be made after deduction of commission, taxes, refunds, chargebacks, penalties, and other recoverable amounts. Payout timelines shall be governed by the applicable Property Owner Agreement or commercial arrangement. Owners shall provide accurate bank account details.

12. INTERIOR AND PAINTING SERVICE PAYMENTS

Work shall commence only after acceptance of the quotation and payment of the prescribed advance amount. Rented Ghar may require stage-wise payments linked to procurement, mobilisation, progress milestones, or completion stages. Final payment shall become due upon completion or handover of the work, subject to agreed terms.

13. MONTHLY RENTAL PAYMENTS

Monthly rental charges shall ordinarily be payable in advance. Rent shall be paid on or before the due date specified in the applicable rental arrangement. Late payment may attract late fees, interest where legally permissible, suspension of services, or termination of occupancy rights.

14. WALLET, COUPON, AND PROMOTIONAL CREDITS

Coupons, cashback, wallet credits, referral credits, and promotional balances are promotional benefits and do not constitute legal tender. Such credits may be subject to validity periods, minimum booking value, property restrictions, and other promotional conditions. Promotional credits are non-transferable and ordinarily non-withdrawable.

15. INTERNATIONAL PAYMENTS

Unless otherwise specified, all charges are denominated in Indian Rupees (INR). Foreign currency conversion shall be governed by the user's bank or payment provider. Foreign transaction fees, currency conversion charges, intermediary bank charges, and similar charges shall be borne by the user.

16. INVOICES AND RECORDS

Electronic invoices, receipts, payment confirmations, settlement statements, and digital records shall constitute valid evidence of transactions. Users shall retain copies of invoices and payment confirmations for taxation, reimbursement, audit, or dispute resolution purposes.

17. FRAUD PREVENTION

Rented Ghar may monitor transactions for suspicious activity, unusual behaviour, velocity checks, identity mismatch, and fraud indicators. Additional identity verification, KYC documents, bank proof, or transaction proof may be requested before processing payments or payouts.

18. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Rented Ghar shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from payment processing, banking delays, gateway failure, network failure, currency fluctuation, chargeback proceedings, or third-party payment service issues.

PART B: UNIFIED PAYMENTS INTERFACE (UPI)

Rented Ghar may accept payments through Unified Payments Interface (UPI) platforms approved by the National Payments Corporation of India and participating banks. Users shall make UPI payments only to UPI IDs, QR codes, payment links, or merchant handles officially communicated by Rented Ghar. A booking shall be deemed confirmed only after successful receipt of funds by Rented Ghar and issuance of an official booking confirmation. A mere screenshot, payment initiation message, pending transaction status, SMS alert, or bank debit notification shall not constitute booking confirmation.

Where a UPI transaction fails due to insufficient funds, network interruption, banking downtime, technical error, authentication failure, timeout, fraud screening, or any other reason, Rented Ghar shall not be obligated to hold inventory or honour the booking unless payment is subsequently received.

PART C: CARDS (DEBIT & CREDIT)

This clause governs all payments made through debit cards, credit cards, prepaid cards, virtual cards, corporate cards, international cards, contactless cards, tokenised cards, and any other card-based payment instrument accepted by Rented Ghar. Users shall make card payments only through secure payment pages, payment links, mobile applications, payment gateway interfaces, point-of-sale terminals, or other payment channels officially provided or authorised by Rented Ghar.

Card payments are processed through PCI-DSS compliant or otherwise authorised payment infrastructure operated by regulated payment service providers. Rented Ghar does not intentionally store CVV numbers, PINs, full magnetic stripe data, or other sensitive card authentication data except to the extent permitted by applicable law and payment industry standards.

PART D: NET BANKING

Rented Ghar may facilitate payments through internet banking services offered by participating public sector banks, private sector banks, foreign banks operating in India, payment banks, and other financial institutions integrated with authorised payment gateways. A net banking payment shall be treated as successful only upon confirmation received from the bank and payment gateway. Rented Ghar shall not be liable for delays caused by banking systems, interbank settlement processes, maintenance downtime, network failures, or technical issues at the bank's end.

PART E: WALLET POLICY

The Wallet may include: (a) user-paid wallet balance; (b) refund credits; (c) cashback credits; (d) promotional credits; (e) referral rewards; (f) loyalty benefits; (g) compensation credits issued by Rented Ghar. Wallet balance may be used only for eligible services available through the Rented Ghar platform. Wallet balance shall be personal to the registered user and shall not be sold, transferred, assigned, gifted, exchanged, or otherwise transferred to another person unless expressly permitted by Rented Ghar.

Unless expressly permitted by applicable law or specifically approved by Rented Ghar, Wallet credits shall not be withdrawable or convertible into cash. Refundable amounts eligible for monetary transfer shall be processed according to the applicable refund policy and payment regulations.

PART F: GST COMPLIANCE

Goods and Services Tax (GST) shall be levied in accordance with the Central Goods and Services Tax Act, 2017, the Integrated Goods and Services Tax Act, 2017, and applicable Uttar Pradesh GST laws. GST may be applicable on services including accommodation booking charges, platform convenience fees, property management fees, commission charged from property owners, cleaning and maintenance charges, interior designing services, and painting and renovation services. Where applicable, Rented Ghar shall issue GST-compliant tax invoices containing required particulars.

Eligibility for claiming Input Tax Credit (ITC) shall be governed solely by applicable GST laws. Rented Ghar does not guarantee that any guest, property owner, company, institution, or other user shall be eligible to claim ITC.

PART G: CHARGEBACK DISPUTES

A chargeback request may arise due to circumstances including unauthorised transaction, duplicate payment, technical payment error, non-receipt of booked service, incorrect billing, transaction processing error, or fraudulent activity. Users shall not initiate fraudulent, dishonest, abusive, or unjustified chargebacks. Such conduct shall constitute a material breach of applicable terms and may result in suspension of services and legal action.

Where a chargeback is decided against the user or where the user has received services against disputed payment, Rented Ghar shall have the right to recover reversed transaction amount, payment gateway charges, bank charges, card network penalties, administrative costs, legal expenses, and collection expenses.

PART H: FAILED PAYMENTS

A payment may fail due to, including but not limited to: insufficient bank balance, incorrect card details, expired or blocked payment instrument, incorrect UPI details, authentication failure, incorrect OTP or PIN entry, transaction limit restrictions, bank server downtime, payment gateway interruption, internet connectivity failure, technical errors, fraud detection or security checks. A booking, reservation, rental agreement, service order, or property allocation shall not be considered confirmed merely because payment has been initiated or money has been deducted temporarily. Where payment has been deducted from the user's account but the transaction is ultimately unsuccessful, the refund or reversal shall be processed according to banking procedures and payment gateway policies.

PART I: TAX DEDUCTED AT SOURCE (TDS)

Where Rented Ghar is legally required to deduct TDS from payouts to property owners, vendors, contractors, consultants, or service providers, such deduction shall be made at applicable rates. Recipients receiving payments from Rented Ghar shall provide valid Permanent Account Number (PAN) details and other information required for tax compliance. Failure to provide valid PAN information may result in deduction of tax at higher rates as prescribed under applicable tax laws. Where required by law, Rented Ghar shall issue TDS certificates to recipients within prescribed statutory timelines.

PART J: INVOICING POLICY

Rented Ghar may issue invoices after successful completion of payment processing, confirmation of service booking, provision of services, or as otherwise required under applicable tax and accounting regulations. Electronic invoices, digital receipts, and electronic records shall be treated as valid documents to the extent recognised under applicable Indian laws. Users shall provide accurate and complete information required for invoice generation, including full legal name, billing address, GSTIN (where applicable), and email address. Rented Ghar shall not be responsible for incorrect invoices resulting from inaccurate, incomplete, or false information provided by the user.
